Terms of Service — Smart Planning Pro

Welcome to Smart Planning Pro. These Terms of Service ("Terms") govern your access to and use of the Smart Planning Pro mobile application ("the App") and all related services.
Smart Planning Pro is operated by Matthieu Faniard, operating under the commercial name L'Agape, registered as an auto-entrepreneur in France.
By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Definitions
- "App" refers to the Smart Planning Pro mobile application and its associated backend services.
- "User", "you", "your" refers to any individual who creates an account or uses the App.
- "We", "us", "our" refers to Matthieu Faniard — L'Agape.
- "Athlete" refers to a user registered with the athlete role.
- "Professional" refers to a user registered as a coach, chef, nutritionist, trainer, physiotherapist, or psychologist.
- "Club" refers to a team or organization created within the App.
- "Content" refers to any text, images, videos, audio, documents, or other material shared through the App.
- "Subscription" refers to a paid plan associated with a club.
2. Eligibility
2.1 Age Requirements
- You must be at least 13 years old to use Smart Planning Pro.
- If you are between 13 and 15 years old, you must have verifiable consent from a parent or legal guardian before creating an account.
- If you are 16 years or older, you may create an account independently.
- If you are under 13, you may not use the App.
2.2 Account Responsibility
By creating an account, you represent that:
- The information you provide is accurate and complete
- You will keep your account information up to date
- You are responsible for all activity under your account
- You will not share your account credentials or allow others to access your account
3. Account Creation & Authentication
3.1 Sign-In Methods
Accounts are created using third-party authentication:
- Google Sign-In
- Apple Sign-In
We do not offer email/password registration. Your account security depends on the security of your Google or Apple account.
3.2 Profile Setup
During onboarding, you will:
- Select your role (athlete or professional type)
- Provide your name and nickname
- Optionally upload a profile photo
- Optionally join or create a club
3.3 One Account Per Person
Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions or for deceptive purposes is prohibited.
4. Subscriptions & Payments
4.1 Free and Paid Features
Smart Planning Pro offers both free and paid features. Certain advanced features and increased club capacity require a paid subscription.
4.2 Club Subscriptions
Subscriptions are associated with clubs, not individual users. A club owner or administrator may subscribe to a paid plan on behalf of their club. The subscribing party is responsible for all associated charges.
4.3 Subscription Tiers
Subscription plans vary in features, member limits, and pricing. Details of current plans, pricing, and included features are available within the App and on our website.
4.4 Billing & Renewal
- Subscriptions are billed on a recurring basis (monthly or annually, as selected).
- Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
- Payment processing is handled by third-party payment providers (including Apple and Stripe). Your payment information is processed directly by these providers and is not stored by Smart Planning Pro.
4.5 Cancellation
- You may cancel your subscription at any time through the App or via the relevant app store.
- Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then.
- No partial refunds are provided for unused portions of a billing period.
4.6 Payment Disputes
For payment-related disputes:
- We encourage you to contact us first at support@smartplanningpro.com. We are committed to resolving issues quickly and fairly.
- For purchases made through Apple, you may also contact Apple Support or request a refund through your Apple account.
- For payments processed via Stripe, dispute resolution is handled through Stripe's standard process.
5. User Roles & Responsibilities
5.1 Athletes
Athletes may:
- Submit daily wellness reports (mood, fitness, sleep, pain tracking)
- Choose which professionals receive their reports
- Join clubs and participate in team activities
- Communicate with professionals and team members
5.2 Professionals
Professionals (coaches, chefs, nutritionists, trainers, physiotherapists, psychologists) may:
- View wellness reports shared with them by athletes
- Create and manage calendar events
- Create weekly menus (chefs)
- Communicate with athletes and other professionals
- Create and manage clubs
5.3 Club Owners & Administrators
Club owners and administrators have additional responsibilities:
- Managing club membership (approving/rejecting requests, removing members)
- Maintaining appropriate conduct standards within the club
- Managing the club subscription
- Ensuring compliance with these Terms within their club
6. Acceptable Use
6.1 You Agree To
- Use the App only for its intended purpose: sports team management, communication, and wellness tracking
- Treat all users with respect and professionalism
- Provide accurate information in your profile and reports
- Respect the privacy of other users
- Comply with all applicable laws and regulations
6.2 You Agree Not To
- Harass, bully, threaten, or intimidate other users
- Send inappropriate, offensive, or sexually explicit content
- Impersonate another person or misrepresent your identity, qualifications, or role
- Share another user's personal data (including wellness reports) outside the App without their explicit consent
- Use the App for commercial purposes unrelated to sports team management (spam, advertising, solicitation)
- Attempt to gain unauthorized access to other users' accounts, data, or App systems
- Reverse engineer, decompile, or disassemble the App
- Upload malicious software, viruses, or harmful code
- Circumvent any security features or access controls
- Create automated accounts (bots) or use the App through automated means
- Use health and wellness data for purposes other than supporting athletic performance and well-being
6.3 Professional Conduct
Professionals using the App are expected to:
- Maintain appropriate professional boundaries with athletes, especially minors
- Not provide services outside their area of expertise or qualification
- Not use the App as a substitute for licensed medical consultations when such consultations are required
- Comply with applicable professional codes of ethics and regulations
7. Health & Wellness Disclaimer
IMPORTANT — PLEASE READ CAREFULLY
7.1 Not a Medical Service
Smart Planning Pro is NOT a medical device, health service, or clinical tool. The App provides a communication platform for athletes and sports professionals. It does not:
- Diagnose, treat, cure, or prevent any disease, injury, or medical condition
- Provide medical advice, clinical assessments, or therapeutic recommendations
- Replace the judgment of licensed healthcare professionals
- Constitute a patient-provider relationship between any users
7.2 Wellness Data Limitations
Daily wellness reports (mood, fitness, sleep, pain tracking) are self-reported, subjective, and for informational purposes only. This data:
- Should not be used as the sole basis for medical, training, or treatment decisions
- Is not verified for accuracy by Smart Planning Pro
- Does not constitute a medical record
- Should be supplemented with proper professional assessments
7.3 Professional Responsibility
Professionals using the App acknowledge that:
- They are solely responsible for any advice, guidance, or decisions they make based on information in the App
- They must exercise their own independent professional judgment
- They should refer athletes to appropriate licensed professionals when health concerns arise
- Smart Planning Pro does not verify, endorse, or guarantee the qualifications of any professional on the platform
7.4 Athlete Responsibility
Athletes using the App acknowledge that:
- Wellness data shared through the App does not replace regular medical check-ups
- They should consult licensed healthcare professionals for any medical concerns
- They are responsible for the accuracy of the information they report
- They should seek immediate medical attention for serious health concerns, not rely on communication through the App
7.5 No Liability for Health Outcomes
Smart Planning Pro expressly disclaims any liability for health outcomes, injuries, or medical conditions that may arise in connection with the use of the App, including but not limited to decisions made based on wellness data, professional advice communicated through the App, or training programs organized through the App.
8. User-Generated Content
8.1 Ownership
You retain ownership of all Content you create and share through the App, including messages, photos, videos, documents, and wellness reports.
8.2 License to Smart Planning Pro
By sharing Content through the App, you grant us a non-exclusive, worldwide, royalty-free, transferable license to host, store, display, and transmit your Content solely for the purpose of operating and providing the App's services. This license:
- Exists only for as long as your Content remains on the App
- Is limited to what is technically necessary to provide the service
- Terminates when you delete your Content or your account
8.3 Content Moderation
We reserve the right to remove Content that violates these Terms. However, we do not proactively monitor all user Content and are not responsible for Content shared by users.
9. Club Management
9.1 Club Creation
Any user may create a club. The creator becomes the club owner.
9.2 Club Ownership & Transfer
- Each club must have at least one owner.
- Ownership can be transferred to another club member.
- If the sole owner deletes their account, the club will be archived unless ownership is transferred beforehand.
9.3 Club Access
Clubs can be configured as:
- Invitation-only: New members require approval from an owner or administrator.
- Open with join code: Anyone with the 6-character code can join.
9.4 Member Removal
Club owners and administrators may remove members from the club. Removed members lose access to club content but retain their personal account and data.
10. Intellectual Property
10.1 Our Property
Smart Planning Pro, including its name, logo, design, code, features, and documentation, is the intellectual property of Matthieu Faniard — L'Agape. All rights are reserved.
10.2 Restrictions
You may not:
- Copy, modify, or distribute the App or any part of it
- Use our trademarks, logos, or branding without written permission
- Create derivative works based on the App
11. Account Termination
11.1 Voluntary Deletion
You may delete your account at any time via Settings > Delete Account in the App. Upon requesting deletion:
- A 48-hour grace period begins, during which you can cancel the deletion by logging back in.
- After 48 hours, your account and associated data are permanently deleted in accordance with our Privacy Policy.
11.2 Termination by Us
We reserve the right to suspend or terminate your account, without prior notice, if:
- You violate these Terms
- You engage in conduct that is harmful to other users, to us, or to third parties
- Your account has been inactive for an extended period (we will notify you before deletion in this case)
- We are required to do so by law
11.3 Effect of Termination
Upon account termination:
- You lose access to the App and all associated data
- Your Content in group conversations may remain visible to other participants
- Club ownership must be transferred before deletion, or the club will be archived
- No refund is provided for any remaining subscription period
12. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be available at all times or without interruption
- The App will be free from errors or bugs
- Data transmitted through the App will be secure against unauthorized access
- The App will meet your specific requirements
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Smart Planning Pro (Matthieu Faniard — L'Agape) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of the App.
- Our total aggregate liability for any claims arising from or related to the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or €100, whichever is greater.
- We are not liable for:
- Actions, advice, or conduct of other users (including professionals)
- Health outcomes, injuries, or conditions related to use of the App
- Decisions made by club owners or administrators
- Loss of data due to circumstances beyond our reasonable control
- Third-party service outages (Firebase, AWS, Apple, Google)
14. Indemnification
You agree to indemnify and hold harmless Matthieu Faniard — L'Agape from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of a third party
- Content you share through the App
15. Governing Law & Disputes
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles.
15.2 Dispute Resolution
If you have a dispute or concern:
- Contact us first. We strongly encourage you to reach out to support@smartplanningpro.com. We are committed to resolving issues amicably and will do our best to find a fair solution.
- Payment disputes related to Apple purchases can be directed to Apple Support. Payment disputes related to Stripe can be handled through Stripe's resolution process.
- If we cannot resolve the dispute informally, it shall be submitted to the competent courts of France.
15.3 Consumer Rights
Nothing in these Terms affects your statutory rights as a consumer under French or European Union law, including your right to a cooling-off period where applicable.
16. Changes to These Terms
We may update these Terms from time to time. When we do:
- We will update the "Last updated" date at the top
- For significant changes, we will notify you via push notification and/or email at least 30 days before the new terms take effect
- Continued use of the App after changes take effect constitutes acceptance of the updated Terms
- If you do not agree with the updated Terms, you should stop using the App and delete your account
17. Miscellaneous
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App.
17.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17.3 No Waiver
Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or our right to enforce it in the future.
17.4 Assignment
We may assign our rights and obligations under these Terms to another entity, provided your rights are not diminished. You may not assign your rights without our written consent.
17.5 Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or third-party service failures.
